Selling a House with Code Violations in Port Orchard, WA
You can sell a Port Orchard house with an open code case without finishing the city’s list first. KindKey Home Buyers LLC buys as a principal from 640 1st St SW, Auburn, WA 98001. Call (206) 519-5463 or use the cash-offer form. KindKey is not a real estate agent. This article is not legal, tax, or code advice.
Port Orchard is an incorporated city and the Kitsap County seat, on Sinclair Inlet. Downtown, Annapolis, Mile Hill, and McCormick Woods are not the same housing. Manchester and Southworth are nearby unincorporated communities. A letter for one of those is not automatically a City of Port Orchard letter.
Read the header before you assume it is the city
Inside Port Orchard, municipal building and code letters come from the city. Unincorporated south Kitsap is Kitsap County. On-site sewage in Kitsap County is handled by the Kitsap Public Health District, which is a different agency from both the city and the county building counter. KindKey will not tell you which hearing to attend.
If the notice has a hearing, a fine, or an order to vacate, talk with a Washington attorney before you rely on a sale to solve it. KindKey will not appear for you, and this article is not legal advice.
What the houses look like
Older houses near downtown and Annapolis, newer houses in McCormick Woods, and larger edge lots that may be on septic show up as different code files. An unpermitted room, a failing outbuilding, tall vegetation, and an unsafe structure after a fire are not one punch list.
Bremerton is across the inlet and has its own city code. Do not use a Port Orchard explanation for a Bremerton header, or the reverse. Gorst is an unincorporated junction, not downtown Port Orchard.
Kitsap recording, and what an offer does not close
Deeds record with the Kitsap County Auditor in Port Orchard. That is true for a city house and for a nearby unincorporated house. The recording office does not close a code case. Until the deed transfers, deadlines on the notice are still yours.
KindKey does not charge an agent commission or a separate assignment fee. Closing-cost responsibility is stated in the purchase agreement and can vary. Payoffs, liens, and taxes can reduce proceeds. The settlement statement shows them before you close. KindKey does not promise that a fine disappears when you sign. If the code case is also a foreclosure or a probate, ask your attorney about RCW 61.34. KindKey does not interpret it.
Selling as-is instead of curing the notice
Curing the notice can be the right path when the fix is small and you want to keep the house. It is a poor fit when the letter requires a tear-out or a repair you cannot fund, and you live in King or Pierce County and cannot manage contractors from the other side of the water.
You do not need a contractor bid before KindKey looks. Photos of the notice and of the condition are enough to start. If the structure is not safe to enter, say so. You can also list the house with a licensed broker. KindKey will not run that listing.
